1. Who is the controller of Customer personal information?

A limited liability company incorporated and organized under the laws of England and Wales, PLANET CARE LIMITED, with its registered office at Sackville House, 1st floor, 143-149 Fenchurch Street, London, England (“PlanetCare”) is the controller of the personal information Customer submits to PlanetCare and responsible for Customer personal information under applicable data protection law. 

2. What information does PlanetCare collect?

PlanetCare collects information about Customer that Customer provides by filling in forms while making purchases on PlanetCare website, namely: name, date of birth, contact details: address, email address, landline and mobile numbers, delivery address, credit card number.

3. How does PlanetCare use personal information?

PlanetCare only uses Customer personal information in order to pursue PlanetCare’s legitimate interests, in order to carry out an agreement PlanetCare has with the Customer, to process the information to comply with legal obligations, to establish, exercise or defend PlanetCare legal rights.

Taking the above in consideration, Customer personal information is used for the following purposes only:

account set up and administration

providing goods and services

advertise and market to the Customer, which includes sending promotional communications, targeting advertising, and presenting Customer with relevant offers.

4. What legal basis does PlanetCare have for processing Customer personal information?

The legal basis for processing of Customer personal information is the execution of the sale and purchase agreement. In this regard, Customer is obliged to provide that information necessary for its execution. If PlanetCare is not provided with this information, the sale and purchase cannot be executed.

In relation to advertising and marketing, the legal basis for the processing of Customer personal information will be the consent of the same, in cases where it has been given.

5. When does PlanetCare share personal information?

Personal information may be shared with information processing companies, such as franchisees and suppliers that provide a service to PlanetCare (courier companies, communications companies…).

6. Where does PlanetCare store Customer personal information?

The information that PlanetCare collects from Customer is stored within the European Economic Area (“EEA”) but may also be transferred to and processed in a country outside of the EEA. Any such transfer of Customer personal information will be carried out in compliance with applicable laws.

7. What rights does Customer have with regard to Customer personal information?

Right of access Customer has the right to obtain confirmation as to whether PlanetCare processes personal information about Customer, receive a copy of Customer personal information held by PlanetCare as a controller and obtain certain other information about how and why PlanetCare processes Customer personal information.  
Right of modification Right of modification Customer has the right to ask PlanetCare to rectify the personal information whenever they are inaccurate, or to complete them whenever they are incomplete. 
Right to erasure/right to be forgotten Customer may ask  PlanetCare for Customer personal information to be erased whenever, among other reasons, the information are no longer necessary for the purposes they were collected for, when PlanetCare legal grounds for processing is consent, Customer withdraws consent and PlanetCare does not have any other lawful basis for the processing; Customer objects to PlanetCare processing for direct marketing purposes; Customer personal information have been unlawfully processed; or Customer personal information must be erased to comply with a legal obligation to which PlanetCare is subject.
Right to restriction Customer has the right to request the restriction of the processing of Customer information, in which case PlanetCare will only keep them for the exercise or defence of complaints.
Right to information portability Customer has the right to receive the personal information in a structured, commonly-used and machine-readable, and Customer has the right to send the information to another organisation (or ask PlanetCare to do so if technically feasible) where PlanetCarelawful basis for processing the personal information is consent or necessity for the performance of PlanetCare contract with Customer and the processing is carried out by automated means.
Right to object Customer may object to the processing of personal information based on the public or legitimate interest pursued by PlanetCare, including direct marketing purposes.
Right to lodge a complaint Customer has the right to lodge a complaint to Information Commissioner’s Office.
